Arrest made on marijuana case
LOCATION:  32700 Block of Lincoln Road          DATE:  04-23-2012          TIME:  1100 hrs
CASE NUMBER:  12-60697         VICTIM:  Sate of CA          CITY:  Visalia

Suspect:
Jeremy Rocha, age  33 of Visalia

On 4/23/12 at 1100 hrs members of the Tulare County Sheriff's Dept. S.T.E.P. Unit responded to the above listed location for the service of a Search Warrant on a marijuana grow reported by neighbors concerned about their safety. Upon arrival detectives contacted the above listed suspect for service of the warrant. The subsequent investigation revealed that the suspect had a valid medical recommendation; however he was growing over his allowed number of plants. The suspect had a medical recommend allowing a total of 70 medical marijuana plants to be grown. It should be noted that doctors recommending marijuana routinely allow the arbitrary number of up to 90 plants to be grown solely because this is under the 100 plant threshold for federal prosecutions. Even 70 outdoor marijuana plants are able to produce several hundred pounds of usable bud over the course of a season when under the care of a competent grower, clearly in excess of any single persons “medical needs.”

It was also found that substandard electrical work had been done on the residence to facilitate the grow creating a fire danger. This information was reported to Edison for later action. In addition it was found that the grow site was protected in a number of manners, the fencing surrounding the property was topped with razor wire and patrolled by several large Pit Bull dogs, a sophisticated surveillance system was operating which included multiple cameras. The suspect was armed with a semi-automatic handgun. It should be noted that while this is a county address it is in a residential area. At the time of the search warrant service small children were playing in the immediate area.

Detectives counted a total of 93 live growing plants, these plants had been started from clones inside a greenhouse, all were heavily budded and ready for the first harvest. Upon determination of the count being over what was legally allowed, the above listed suspect was detained. He refused to answer any questions about the marijuana cultivation. The amount of marijuana found was clearly in excess of the above listed suspect’s medical needs, he was arrested and booked without incident.

It is an ongoing problem that persons are obtaining medical marijuana recommends from doctors who allow them to grow plants well in excess of their medical needs, then sell the excess to a dispensary or on the street. The above suspect was arrested and charged with cultivation of marijuana and possession for sales. The marijuana bud if allowed to mature would have a street value well in excess of $3,000 per plant.

In addition to the above, the owner of the property was provided notification advising that allowing cultivation of marijuana is a Federal felony. Allowing a renter to do this exposes the property to seizure by the Federal government through  asset forfeiture.

This case is still under investigation by the TCSO STEP Unit.

Cultivation of marijuana, Poss. For sale
LOCATION:  42700 block of Rd. 104, Sultana          DATE:  04-06-12          TIME:  1230
CASE NUMBER:           VICTIM:  State of California          CITY:

S1. Raul Madrid,  54 yoa, Out of Sultana
S2. Gabino Sanchez Chavez, 18 yoa, Out of Orosi Ca.
S3. Mario Rodriguez Silva, 21 yoa, Out of Rialto Ca.

On the above date and time detectives from the Tulare County Sheriff’s Office S.T.E.P. Unit responded to the 42700 block of Rd. 104 for compliance check on reported marijuana grow. Local neighbors had called in to report that large plywood fences were being put up at the location and they feared subjects would be growing marijuana inside the enclosure potentially bringing violence into the area.

Upon arrival detectives observed subjects working inside the structure, when the subjects observed the marked Sheriff Patrol units several fled into the surrounding orange grove.  Subsequent investigation found that the large property contained three separate fenced enclosures being rented out, each had their own medical marijuana recommends posted inside; however the sites shared a common watering system. It was found that each enclosure had more than the allowed number of plants covered on the medical recommends present. A total of (1626) growing marijuana plants were counted within all three enclosures, medical recommends present only allowed for (457) plants. Upon questioning the above listed suspects it was determined that even (457) plants were excessive for their stated medical needs. It should be noted that the commonly accepted yield for an outdoor marijuana plant for court purposes is one pound per mature plant, however suspects themselves often brag about getting 3 to 5 pounds of bud per plant. If each plant yielded one pound the street value of the marijuana produced would be approx. $4,000 per pound, more when shipped out of state.

It should be noted that it has become common for Drug Trafficking Organizations to hide behind California’s poorly written medical marijuana laws which do not limit the number of plants a person can have or have a central register of who is growing marijuana at what locations. Large Drug Trafficking Organizations set-up these “Plywood Grows” on farmland around the valley. They make multiple copies of marijuana recommends and scatter them around many grow sites where an officer investigating has no mechanism to check if the recommend might be posted in other areas.

Due to the excessive amount of marijuana present all plants were eradicated and the above suspects arrested. They were transported and booked without incident at the Tulare County Jail.

The property owners who were renting out the space were also contacted and advised the Federal Government is starting a program to advise the owners of the property where marijuana is being grown that allowing marijuana cultivation is a Federal Felony, if the owner knowingly allows marijuana growing by a renter or grows marijuana themselves, their property can be seized by the Federal Government. California’s medical marijuana laws are no defense in Federal Courts and this notification by local law enforcement serves to eliminate the “Innocent Owner” defense for Federal Cases.

This case is still under investigation by the TCSO STEP Unit.
