Arrest made on sexual assault case

On 9/29/2012 the Tulare County Sheriff's Office Crimes Against Children, Investigations Unit was contacted by Tulare County Child Welfare Service. Detectives were advised that a confidential juvenile reported that Franco Toledo had sexually assaulted him. An investigation was conducted and Franco Toledo was arrested on 10-31-2012 for three counts of PC 288(a).  Toledo was a volunteer for Granite Hills High school Band and Pioneer Middle School Band. He was also employed with Youth Experience Success Program through the Porterville Unified School District. 

 

Franco Toledo, age 22 of Woodville, was booked into the Tulare County Main Jail with bail set at $300,000.00.

Defendant in court attempts assault on peace officer

On Wednesday, October 31, 2012 at approximately 1059 hours a defendant who was being read the verdict on his case assaulted the lead detective on the case while in court. 

The defendant, Michael Risenhoover age 34 of Tulare, was a former Correctional Deputy for the Tulare County Sheriff’s Office.  Risenhoover was in court, Department Four with presiding Judge Seviere for allegations of sexual assault of a minor.  Additional court security were present in the courtroom at the request of the Judge and Sheriff’s Management based on the sensitivity of the case, the defendants knowledge of our courtroom security and past statements in relation to safety  issues made by the defendant.

The defendant’s verdicts were as follows:
PC 288.7 PC – 2 counts, Guilty
PC 288(A) – 6 counts, Guilty
PC 288 (B)(1) – 2 counts, Guilty

After the verdicts for a few charges had been read as guilty, Reisenhoover quickly reached past his attorney and grabbed the Tulare County Sheriff’s Detective, who was lead investigator.  The detective was seated approximately six to eight feet away.  Resenhoover was able to reach the detective’s neck then attempted to grab her service weapon.  Bailiffs grabbed Risenhoover and deployed a taser in order to gain compliance and restrain him.  Risenhoover was successfully restrained without any further incident and removed from the courtroom.  The detective, a 13 year veteran of the Tulare County Sheriff’s Office, was medically cleared and is on leave pending the investigation.  The defendant was later returned to the courtroom to continue the reading of his verdict under additional security.

Tulare County Sheriff’s Detectives are investigating the assault case.  The current charges being sought for this case are PC 243 (C) and PC 69. The case is still under investigation as all parties who were present in the courtroom at the time of the incident are being interviewed.

Upon completion of the court proceedings, Risenhoover was immediately transported back to his housing facility in Kings County under additional transport security.

Shooting Investigation in Plainview Area

UPDATE 10-31-12:
The Sheriff's Tactical Enforcement Personnel Unit is conducting the investigation into the medicinal marijuana issues regarding this case. Detectives located 131 pounds of processed marijuana for sales in one pound packages.  There was an additional 30 pounds of partially processed marijuana that would yield approximately 24 additional pounds of marijuana bud.  The total weight of useable/sellable marijuana would be approximately 155 pounds.  Based on the information in the posted recommendations this amount is in excess of at least 125 pounds of what was allowed and was packaged for sales. Street value for marijuana ranges anywhere from $1000 per pound and up depending on if it sold to or in a dispensary, on the street or transported out of state where it would yield over $3000 per pound or more.

The Sheriff's Office has had various cases regarding theft, attempted theft, homicides or assaults over medicinal marijuana.  County Ordinances have been created to help protect those who obtain medicinal marijuana recommendations and operate within these guidelines.  A majority of cases where medicinal marijuana is present have found the recommend holders to be out of compliance with County Ordinances.  Specific zoning and security issues are listed to help protect community residents also.

Individuals who obtain their recommendations are often misinformed by the doctors that they can donate their excess marijuana to a dispensary which will then donate cash back to the grower. Under California law this is still considered sales of marijuana, which is a felony. 

Another issue recommend holders face is harvesting.  Because of the yield of most strains of marijuana currently grown in the valley, even an inexperienced grower can harvest at least one pound of product from each marijuana plant. Recommendations commonly list a specific amount of allowable "processed" marijuana. As soon as the plants are cut down and the processing started, they are no longer "plants".  The material is now considered "partially processed marijuana" and is counted toward the allowable amount listed on the recommend.  The plant count is converted to a weight of useable bud and transferred to the processed amount. A majority of cases prove to be well over the allowable processed amount.

 

UPDATE:
After further investigation, it was determined the victim was shot while inside a residence during an attempted robbery of medicinal marijuana.  Several subjects entered the residence attempting to steal a large amount of processed marijuana.  The victim was inside this residence when the suspects arrived and shots were fired.  The suspects fled and the victim was transported by a personal vehicle to a local hospital. 

Medicinal marijuana recommendations were located at the residence along with a large amount of processed marijuana.  The marijuana was seized as evidence and the Sheriff's Tactical Enforcement Personnel Team was called to take over the marijuana investigation portion of the case.  They will determine if the amount of processed marijuana is in compliance with the recommendations that were on scene.

PRIOR RELEASE:
On Tuesday, October 30, 2012 at approximately 1516 hours, the Tulare County Sheriff’s Office received a call from a local area hospital regarding a possible shooting victim.  Deputies learned that a possible shooting occurred at the 14600 block of Vista in Plainview where the victim was struck.  The victim was transported by private vehicle to the local hospital where he was admitted.  No other injuries were reported. 

Detectives from the Violent Crimes and Forensic Investigations Units were dispatched to investigate the case.

Arrest made on pursuit of stolen vehicle

On 10-29-2012 at approximately 1034 hours, the Tulare County Sheriff’s Office received a call of a possible stolen vehicle in the area of Road 160 and Avenue 330 in Ivanhoe.  Deputies responded to the area and were able to locate the vehicle driving northbound on Road 156 from Avenue 328.  A traffic stop was initiated but the suspect failed to stop and a pursuit began.  Due to the time of day, traffic conditions and area the original pursuit was cancelled but deputies remained in the area checking through several orchards and roadways.  The Sheriff’s Air Unit was able to locate the vehicle again and with the assistance of Woodlake Police Department, California Highway Patrol and the Sheriff’s Tactical Enforcement Personnel (STEP) Unit the suspect vehicle was stopped in the area of Saint Johns River at Road 160, Ivanhoe Drive.  The suspect ran from the vehicle and was taken into custody after a short chase on foot.


After further investigation, it was discovered the vehicle was a stolen truck from Visalia Gropetti Automotive.  There were also several stolen tires and rims from Don Rose Oil of Visalia.  The suspect was also found to be under the influence of a controlled substance and in possession of a useable amount of a crystalline substance believed to be methamphetamine.


The suspect was identified as Chesley McMains, age 40 from Woodlake.  The suspect was arrested on charges of:

PC 496D Purchase or receipt of stolen vehicle
PC 148 Resisting arrest
HS 11377(A) Possession of a controlled substance
PC 496(A) Receiving stolen property
HS 11550 Under the influence of a controlled substance

Total Bail:  $110,000.00

Officer Involved Shooting, Goshen Area

On 10-26-2012 at approximately 2330 hours VPD officers witnessed a white Hyundai Sonata run through a stop sign intersection at Locust and Grove in Visalia.  They attempted a traffic stop on the vehicle while continuing south on Locust toward Mineral King.  The vehicle failed to stop and continued to drive away.  A second VPD unit with a K-9 followed in pursuit.  The suspect vehicle entered west bound 198 then transferred to northbound HWY 99.  The suspect vehicle exited HWY 99 at avenue 304 where it lost control and rolled over in a dirt lot at the 30400 block of Road 69 in Goshen.

 

VPD officers exited their vehicles, began to approach the suspect vehicle ordering the suspects to show their hands.  Three suspects exited the vehicle through the windows and began shooting at the officers.  The Officers returned fire striking all three suspects.  Two suspects remained inside the vehicle.  Initially the K-9 Officer deployed his K-9.  When shots were heard, the K-9 was called off and returned to the officer.  None of the Officers nor K-9 was injured. 

 

One suspect, Ruben Molina age 22 of Earlimart, was pronounced deceased on scene.  The second suspect, Edwardo Maduena age 19 or Earlimart, was transported and pronounced deceased at a local area hospital.  The third suspect, Nicholas Chavez, age 18 of Pixley, was transported to a local hospital where he has been admitted and under care for his injuries.

 

The two suspects that remained in the vehicle were arrested.  Robert Ruiz, age 21 of Tipton, is in custody for attempted homicide and homicide.  A seventeen year old female from Visalia was also arrested for attempted homicide and homicide.  Edwardo Maduena was a wanted felon who has been known to carry a firearm.  Investigation is still ongoing to determine if there is any connection to gangs in the area.  

 

All three officers from Visalia Police Department discharged their service weapons.  Each officer has over seven years of experience in law enforcement.  Per standard procedure with the Visalia Police Department, all three officers were placed on paid administrative leave.

Possible Human Remains Located Near Lake Success

UPDATE 10-30-2012:
Cause of death has been listed as "undetermined probable suicide".  The investigation regarding the missing person case revealed some additional information.  It is believed Noble's death is a probable result of suicide.  During the initial missing person report, detectives were advised Noble walked away from his parents home after a verbal argument.  Additional information was later received that this did not occur.  The family advised he left under good terms before being reported missing.

UPDATE 10-29-12: 
Identification of the human remains located have been verified through dental records as Gerald Noble, age 23 of Porterville.  Gerald was previousl reported missing on August, 24, 2012.  Cause of death is still under investigation and pending a coroners report, although detectives have not identified any obvious signs of foul play at the scene.


PRIOR Release 10-29-12:
On Sunday, October 28, 2012 at approximately 1836 hours, Tulare County Sheriff's Office received a call from a family who were riding horses near Lake Sucess.  The family reported locating possible human remains.  A Detective was dispatched to the area.  The Detective secured the area overnight.  Additional Detectives from the Coroner's Office, Forensic Investigations and Violent Crimes Office responded to the area during daylight conditions and examined the remains.  The remains do appear to be human and identification of the remains is under investigation as well as cause of death.  As additional information is obtained an update will be posted.

 

PRIOR RELEASE:
On 8-24-12 at approx 1400 hours, Deputies with the Tulare County Sheriff’s Department, Porterville Station, were contacted regarding a missing person, Gerald Noble, who walked away from his residence after a verbal argument with his parents.  Noble is considered an at risk missing adult. Noble was last seen leaving his parents residence, which is located in the 30000 block of Holdridge Dr in the Porterville area.  Noble was last seen wearing blue jeans, tennis shoes and unknown color of shirt. Noble is 23 three years old, 6'04" in height, weighs 170 pound, with brown hair and green eyes.
 
Detectives with the Tulare County Sheriff’s Department are currently investigating Noble’s disappearance as an endangered missing adult. Noble is believed to be on foot with no means of transportation. Noble has no previous pattern of running away or disappearing.

On 10-26-12 at about 2:00 am, three suspects broke into the victim’s residence in the 11000 block of Avenue 360 in rural Visalia while they were home and held them at bay with firearms for a robbery of certain belongings, which included a fair amount of processed medical marijuana, a rifle, and their personal vehicle. Two of the suspects wore masks to disguise their identity during the commission of the crime. The suspects fled the scene in the victim’s vehicle and there were no injuries reported.

Through further investigation, personnel from the sheriff’s department served a search warrant in the 500 block of Fowne Ct. Bakersfield, Ca. Officers from the Bakersfield Police Department and Southern Tri-County HIDTA assisted with the case.

Personnel located the majority of the stolen property, arrested two adults and placed three children into protective custody. The adults arrested were identified as Julio Cruz (27 years) and Bertha Cibrian (32 years), both reside in Bakersfield and were booked into the Tulare County Main Jail and the Bob Wiley Detention Facility. The children’s ages were from seven years to 14 years.

Julio Cruz (27 years) was arrested for home invasion robbery, possession of stolen property, auto theft, child endangerment, possession of a firearm with mask, possession of marijuana for sale, possession of a controlled substance and conspiracy to commit crime. Bail was set at $100,000.00 pending his arraignment in court.

Bertha Cibrian (32 years) was arrested for home invasion robbery, possession of stolen property, conspiracy to commit crime and child endangerment. Bail was set at $100,000.00.

Detectives from the Tulare County Sheriff’s Department are continuing the investigation and other suspects are being sought.

10-26-12 at approximately 1000 hours, Deputies were dispatched to the northwest corner of Ave 152, Road 208, west of Porterville in regards to a theft in progress. Upon arrival, eight subjects were detained for taking approximately 700 pounds of walnuts from the orchard. The walnuts were recovered at the scene and some recovered from three vehicles at the scene. The victim reported he did not give anyone permission to remove any walnuts from his property. All eight subjects were arrested and booked at the Porterville Substation and the Bob Wiley Detention Facility. The estimated loss and recovery was $1,020.

On 10/24/12 Investigators from the Sheriff’s Departments STEP Team were assisting code enforcement personnel from the Resources Management Agency in serving a Civil Marijuana Abatement notice in the 30800 Blk of Merhten Dr. Exeter, Ca.. When serving the notice the investigators came into contact with Mathew Ramos. Ramos provided the investigators with a false name and identifying information. The investigators attempted to take Ramos into custody and Ramos violently resisted arrest causing minor injuries to the investigators. Ramos was restrained. During the fight Anthony Ramos instigated and assisted Mathew Ramos. After the situation was quelled it was revealed that Mathew Ramos was a wanted parolee and had two active arrest warrants one which was out of the State of Nevada.
Investigators then served a search warrant at the residence for the cultivation of Marijuana. Rebolllero was found trimming and processing the marijuana bud. The ensuing search and investigation revealed approximately fifty four pounds of partially processed and processed marijuana, seventy two mature marijuana plants, concentrated cannabis and indicia related to the sales of marijuana. The marijuana was far in excess of any medical marijuana recommendations and was being taken care of under the guise of medical marijuana.
Lisa Ramos was found to have an active arrest warrant and was taken into custody with out incident. All the suspects were taken into custody and booked at their respective jail facilities on the listed charges.

After an approximate Four (4) week investigation into illegal narcotics trafficking in the Farmersville area, investigators from the Inter-Agency Narcotics Enforcement Team were led to a residence in the 300 Blk of Kern Ave. Farmersville, Ca. where a search warrant was served.  The ensuing investigation and search revealed that the listed suspects were in possession of approximately 3 grams of Methamphetamine, indicia related to the sale of Methamphetamine, scales, packaging materials, one short barreled shotgun and maintaining a residence for illicit narcotic sales. One large mature marijuana plant was located in the back yard.During the service of the search warrant Gamez and Navarro delayed the investigators in the performance of their duties by denying and stalling entry into the residence. Gamez was using her children as protection, it was also determined that the illicit narcotics and weapons were with reach of the children.  Navarro is also a previously convicted felon. The suspects were taken into custody without incident. The children were taken into protective custody and released to CWS.
The suspects booked at the respective Tulare County Jail Facilities on the listed charges.

On 10/22/2012 at approximately 1930 hours, Deputies from the Tulare County Sheriff's Departments Porterville Division responded to the 19200 block of Road 236 in Strathmore regarding a report of a brandishing of a firearm during a custody dispute. Ricardo Nunez, 19 of Strathmore, pointed a handgun at the mother of his three children, ages 5 months to 1 year old during an argument over custody and visitation.  

 

During the investigation, Deputies located a large outdoor marijuana grow site and stolen vehicle chop shop at the property. The majority of the estimated 400+ plants had been previously harvested. Deputies pulled fifty (50) mature marijuana plants, located approximately ninety (90) pounds of fully processed marijuana packaged for sale, scales, narcotic packaging materials, methamphetamine packaged for sale, two loaded firearms, a stolen vehicle and numerous additional stolen vehicle parts. Deputies located five children between the ages of five months to seven years living in deplorable conditions within the residence. As a result of the living conditions and illegal activity, all five children were removed from the residence and placed in foster care by Child Welfare Services. 

 

Nunez was arrested along with his father, Natividad Nunez-Arteaga, 44, Benjamin Valdez, 28 and Pedro Villalobos-Meraz, 30 for numerous charges including child endangerment, cultivation of marijuana, possession of marijuana for sale, possession of methamphetamine for sale, possession of a firearm while committing a felony, possession of a stolen vehicle, possession of stolen vehicle parts, operating a stolen vehicle chop shop and maintaining a location for unlawful activities. This case is under active investigation by the Tulare County Sheriff's Department and California Highway Patrol.

On 10/22/12 at approximately 1540 hours deputies responded to the 35100 block of Road 52 regarding a report of a theft in progress. Employees of the victim confronted the suspect, George Edward Boston, who was attempting to steal a commercial watering truck, having driven it a short distance but failed to release the air brakes. Boston then attempted to flee on foot but was apprehended and detained by employees while deputies were still en route. Deputies arrived and took custody of Boston. The vehicle, valued at $6000, was returned to the owner.

 

The case is currently under investigation by the Tulare County Sheriff’s Office.

On October 19, 2012 Investigators’ from the California Department of Corrections Fugitive Apprehension Team were in the 10700 Blk of Ave 16, in the Delano area looking a wanted parolee. When the investigators arrived at a residence in the area several subjects fled the area on foot and the investigators uncovered a large scale marijuana processing operation. Deputies from the Sheriff’s Departments Pixley substations responded to assist the parole agents. The listed suspects were located either in the buildings or on the property assisting in the manicuring and processing of the Marijuana. The property was seized and Detectives from the STEP Team were called in to take over the investigation.

A search warrant was written for the location and the ensuing search and investigation revealed three large building on the property and marijuana was found in the buildings in the various stages of drying and processing. There was living areas as well. Approximately Five Hundred (500) pounds of partially processed Marijuana, Two Hundred fifty pounds of processed marijuana packaged for sales and distribution, scales, packaging materials, indicia related to the sales of marijuana and a large amount of US Currency. Seven (7) firearms were located as well, one of which was an assault style rifle, and several handguns with large capacity magazines. Also located was large amount of shipping material from a major US shipping company for distribution purposes. It was determined that the listed suspects were performing various duties involved in the sales of marijuana under the guise of medical marijuana.

All the suspects were taken into custody without incident for Possession for sales of Marijuana and Conspiracy and booked at the Tulare County Jail on the listed charges.

  After an approximate one month investigation into the cultivation of Marijuana in the unincorporated rural area of Visalia, Investigators from the Sheriff’s Departments STEP Team were led to a residence in the 13700 Blk of Ave 352 where a search warrant was served. Upon the investigators arrival, Suspects’ Sweeney, Borges, Smith and McCain were found in the residence manicuring dried marijuana bud and Guire and Macias were located in an 84 plant marijuana grow tending to the fully mature budding plants. The ensuing search and investigation revealed approximately one hundred fifty pounds of partially processed and processed marijuana, concentrated cannabis (in various stages/ types), fifteen plants in various stages of growth in an indoor grow, grow lights, indoor and outdoor growing material, indicia related to the sales of marijuana and a time clock and time cards along with an amount f U.S. currency. The marijuana was far in excess of any medical marijuana recommendations and was being taken care of under the guise of medical marijuana.
All the suspects were taken into custody with out incident and booked at their respective jail facilities on the listed charges.
